After a three-day arbitration hearing in New York, FSC secured a comprehensive victory in a breach of fiduciary duty and breach of contract dispute between its client and a majority shareholder in a private investment dispute. FSC’s client was awarded all of its requested relief, including an additional share in the joint venture investment, as well as seven-figures in monetary damages.
The arbitration panel found that FSC’s client had improperly been denied contractual and fiduciary benefits by the respondent and granted FSC’s client additional safeguards so that the abuse would not continue into the future, including an injunction preventing the respondent from devaluing FSC’s client’s investment going forward.
Shareholders Jonathan T. Suder and Glenn S. Orman represented the prevailing party throughout this hard-fought victory.
